The Complex Reality of Practising Law Abroad as an Indian
Law is perhaps the most jurisdiction-specific profession in the world. A doctor trained in India can, with additional exams, practise medicine almost anywhere. An engineer's skills are universally applicable. But a lawyer trained in Indian law cannot simply relocate and start practising in the UK, US, or Australia. Legal systems differ fundamentally -- common law vs. civil law, different constitutional frameworks, different regulatory regimes, different court structures -- and each country guards entry to its legal profession through rigorous qualification requirements. This does not mean that international legal careers are closed to Indian law graduates. It means they require careful planning, additional qualifications, and a strategic understanding of which pathways actually work.
I have counselled Indian law graduates who now practise at Magic Circle firms in London, at top-tier US law firms in New York, at international arbitration chambers, and at multinational corporations' legal departments across the world. Their journeys were different, but they all started with the same question: which qualification pathway makes sense for my career goals? Let me walk you through the options.
Understanding Legal Systems and Qualification Pathways
England and Wales (UK)
The UK is the most accessible international legal market for Indian law graduates. There are two traditional routes to qualification:
Solicitor Route:
- Previously required the Legal Practice Course (LPC) + 2-year training contract
- Now transitioning to the Solicitors Qualifying Examination (SQE). SQE 1 tests legal knowledge through multiple-choice assessments. SQE 2 tests practical legal skills.
- Indian LLB graduates can take the SQE directly after obtaining a character and suitability declaration from the SRA (Solicitors Regulation Authority).
- Still requires 2 years of qualifying work experience (can be in up to 4 organisations).
- Training contract or qualifying work experience can be at law firms, in-house legal departments, or public sector organisations.
Barrister Route:
- Requires completing the Bar Course at an approved provider in England and Wales.
- Requires pupillage (12 months of supervised practice at a barristers' chambers).
- Indian LLB graduates may need to pass the Bar Standards Board's assessments.
- Pupillage is extremely competitive -- approximately 400 positions available for 1,500+ applicants annually.
For Indian law graduates, the solicitor route via SQE is generally more practical and has clearer employment prospects. Major international law firms in London actively recruit talent from diverse jurisdictions.
United States
Qualifying to practise law in the US as an Indian graduate is state-specific. The key credential is the bar exam, but not all states allow foreign-trained lawyers to sit for the bar.
LLM Route:
- Most Indian law graduates pursue an LLM (Master of Laws) at a US law school accredited by the ABA (American Bar Association).
- An LLM from an ABA-accredited school makes you eligible to sit for the bar exam in certain states -- most notably New York and California.
- New York bar: The most popular choice for foreign lawyers. New York allows LLM graduates from ABA-accredited schools to sit for the bar exam without completing a JD.
- California bar: Also allows LLM graduates, but the California bar exam is considered the most difficult in the US.
- Other states have varying requirements -- some do not allow foreign-trained lawyers at all.
JD Route:
- The JD (Juris Doctor) is the standard US law degree. A 3-year programme that provides comprehensive US legal education.
- More expensive (USD 150,000-250,000 total cost) but provides a stronger foundation for long-term US legal practice.
- Indian graduates with an LLB can enter JD programmes -- some schools offer advanced standing or credit for prior legal education.
- JD graduates can sit for the bar exam in any state.
Australia
Australia's legal qualification pathway for Indian graduates involves:
- Assessment by a state Legal Practice Board to determine which Australian law subjects you need to complete
- Completing required "top-up" subjects (typically Constitutional Law, Administrative Law, Equity, and other Australia-specific subjects)
- Practical Legal Training (PLT) -- typically a 5-6 month programme combining coursework and work experience
- Admission to the Supreme Court in the relevant state
The Australian pathway is more structured than the US but less rigorous than starting from scratch. Indian LLB holders typically need to complete 5-8 additional subjects rather than a full degree.
Canada
Canada requires foreign-trained lawyers to:
- Apply to the National Committee on Accreditation (NCA) for assessment
- Complete NCA-assigned courses to address gaps between Indian and Canadian legal education
- Complete provincial licensing requirements (bar exam and articling)
- Ontario requires completion of the licensing process through the Law Society of Ontario
International Legal Practice (Without Local Qualification)
Many international legal careers do not require local bar qualification. Indian-qualified lawyers can work in:
- International arbitration: Arbitration proceedings are not tied to local bar requirements. Indian lawyers with expertise in commercial arbitration work at international chambers and arbitration institutions worldwide.
- International law firms' India desks: Many Magic Circle and large US law firms have India-focused practice groups that specifically hire Indian-qualified lawyers.
- In-house legal departments of multinational corporations: Companies with Indian operations need lawyers who understand Indian law. These roles may not require local bar admission.
- International organisations: The UN, World Bank, WTO, and similar organisations hire lawyers from diverse jurisdictions for international law roles.
- Legal process outsourcing (LPO): Indian-trained lawyers working for international legal services companies, handling document review, research, and contract management for Western law firms.
Top Law Schools for Indian Students Going Abroad
LLM Programmes
- US: Harvard Law School, Yale Law School, Columbia Law School, NYU Law (particularly strong for international law), Georgetown (strong for public interest law). For New York bar eligibility, NYU and Columbia are popular choices due to their location and bar exam preparation support.
- UK: University of Oxford, University of Cambridge, UCL, LSE, King's College London, SOAS (strong for international law and human rights).
- Australia: University of Melbourne, University of Sydney, UNSW.
Choosing the Right Specialisation
LLM specialisations that are particularly valuable for Indian lawyers going international:
- International Commercial Arbitration: Growing rapidly as cross-border disputes increase. Singapore, London, and Paris are major arbitration centres.
- Corporate Law / M&A: Essential for roles at international law firms handling cross-border transactions.
- Intellectual Property: Particularly valuable as Indian companies expand globally and need IP protection across jurisdictions.
- Tax Law (International): Transfer pricing, international tax planning, and tax treaty interpretation are high-demand specialisations.
- Technology Law and Data Privacy: GDPR, data protection, and technology regulation are creating new legal specialisations worldwide.
- Energy and Environmental Law: Climate change regulation, carbon markets, and renewable energy law are growth areas.
Working at International Law Firms
The Magic Circle and White Shoe Firms
The most prestigious international law firms include:
- UK Magic Circle: Clifford Chance, Allen & Overy, Linklaters, Freshfields, Slaughter and May. These firms hire internationally-trained lawyers for their London offices and global network.
- US White Shoe: Sullivan & Cromwell, Davis Polk, Wachtell, Cravath, Skadden. Highest-paying law firms globally.
- US V100: Kirkland & Ellis, Latham & Watkins, Simpson Thacher. Major employers of LLM graduates.
Indian lawyers at these firms typically work in practice areas that leverage their Indian legal knowledge: India-related M&A, cross-border transactions, international arbitration, and capital markets. Some transition to general corporate or litigation practice after establishing themselves.
Salary Expectations
International law firm salaries are among the highest in any profession:
- US (large firms): First-year associate: USD 215,000-225,000 base salary + bonus. This is the Cravath scale, followed by most top firms. After 5-7 years: USD 350,000-500,000+. Partners: USD 1,000,000+.
- UK (Magic Circle): Newly qualified solicitor: GBP 100,000-125,000. After 4-5 years: GBP 150,000-200,000. Partners: GBP 500,000-2,000,000+.
- In-house (multinational): General Counsel / Senior Legal: USD 150,000-400,000+ depending on company and jurisdiction.
- International arbitration: Junior associates: USD 80,000-120,000. Senior practitioners and arbitrators: USD 300,000-1,000,000+.
Visa and Immigration for Legal Careers
- US: LLM programmes are not STEM-designated, so you get only 12 months of OPT. Large law firms sponsor H-1B visas, but the lottery applies. JD graduates fare better with potentially STEM-designated programmes and broader employment options.
- UK: The 2-year Graduate Route visa is excellent for establishing your legal career. Solicitors and barristers qualify for Skilled Worker visa sponsorship. Training contracts at law firms include visa sponsorship.
- Australia: Legal practice qualifies for skilled migration. The pathway to permanent residency is clear for qualified solicitors.
- Singapore: Singapore's legal market welcomes foreign lawyers for international law work. Registration as a Foreign Lawyer allows practice in international arbitration and cross-border transactions without full Singapore qualification.
Building Your Profile for International Legal Careers
- Academic excellence: Top international law firms recruit based heavily on academic performance. A strong CGPA from a top Indian law school (NLUs, faculty of law at top universities) is the foundation.
- Mooting and debating: International moot court competitions (Vis Moot, Jessup, ICC Moot) provide exposure, networking, and demonstration of advocacy skills.
- Research publications: Published articles in reputable law journals strengthen LLM applications and demonstrate intellectual depth.
- Internships at international firms: Summer placements at international law firms with India offices (virtually all Magic Circle firms have Indian presence) provide direct exposure.
- Language skills: For European legal markets, language skills in French, German, or Spanish add significant value.
Alternative Legal Careers Abroad
Not every legal career requires bar qualification or law firm partnership. Alternative paths include:
- Compliance: Financial services compliance, anti-money laundering, sanctions screening. Major banks and financial institutions hire lawyers for compliance roles globally.
- Legal technology: The intersection of law and technology -- AI-driven contract analysis, legal research platforms, litigation analytics. Companies like Kira Systems, Relativity, and LegalZoom hire lawyers with tech literacy.
- Policy and regulation: Working at regulatory bodies, government agencies, or international organisations on legal policy development.
- Legal consulting: Firms like McKinsey, BCG, and Deloitte have legal consulting practices that hire qualified lawyers for advisory engagements.
- Academic careers: Teaching law at international universities. Requires PhD/SJD and research publications.
The Bottom Line
International legal careers are among the most demanding qualification pathways for Indian graduates. The licensing requirements are complex, the additional education can be expensive, and the competition is fierce. But the rewards -- both financial and professional -- are exceptional. The global legal market needs lawyers who can navigate multiple jurisdictions, understand cross-border transactions, and bring diverse perspectives to complex legal problems. Indian law graduates with strong academic records, international qualifications, and strategic career planning can and do build remarkable careers at the highest levels of the global legal profession.
